Religious freedom demands reproductive freedom

Summary

Reproductive freedom and religious freedom are intertwined. To have religious freedom you must be free to make your own decisions about your own body based on your own beliefs. That’s why religious freedom demands the right to abortion, birth control, fertility care and other reproductive health care.

Abortion bans and restrictions on contraception and in vitro fertilization violate our country’s promise of church-state separation because they impose one narrow religious view about conception and reproduction on everyone.

Abortion bans violate the separation of church and state

Christian Nationalists and their lawmaker allies have been misusing religious freedom to reshape reproductive law and divide our nation for decades. They openly cite religious scripture or personal beliefs as support for anti-abortion legislation and they work with powerful Christian Nationalist organizations to codify their beliefs into law. 

Today’s anti-abortion movement was initially created to unite religious conservatives against civil rights, feminism, and the new sexual-freedom movement that was reshaping American society in the 1970s and ‘80s. Plus, blocking access to reproductive health care is a powerful way to control economic and social status. Restricting people’s reproductive freedom impacts not only their health but also their financial stability, workplace opportunities, educational attainment, and overall social mobility. And the implications of these restrictions for people of color are more severe due to systemic racism, economic disparities and health care inequities.

Fighting for reproductive freedom

This is why Americans United defends reproductive freedom and the freedom for everyone to make their own personal medical decisions about their own bodies. We oppose religious extremists who want to use the law and the courts to impose their narrow views on everyone. We fight in the legislatures, courts, and public forums because using religion as a license to harm others threatens all of our freedoms and widens inequality in our country.

Restricting abortion access

Executive Order prohibiting funds

President Trump signed an executive order prohibiting the use of federal funds for abortion care. This order rescinded previous directives that had expanded access to reproductive health care, including abortion services.

Public protects abortion access

Voters defend abortion rights

In the 10 states where reproductive rights were on the ballot in 2024, a majority of voters in seven states supported enshrining abortion access in their state constitutions. Voters in six other states had already defended abortion access in the wake of the Supreme Court's 2022 decision to abolish Roe v. Wade.

Project 2025

Anti-abortion agenda

Project 2025 calls for banning medication abortion (the most accessible form of abortion) and limiting reproductive health care, including ramping up "abortion surveillance” to intimidate pregnant people and limiting access to emergency contraception.

U.S. Reps. Bobby Scott, Jamie Raskin, Steve Cohen, and Mary Gay Scanlon and U.S. Sen. Cory Booker reintroduce The Do No Harm Act in Congress. This act will help protect religious freedom for all while ensuring that it can’t be misused to harm others, including by denying access to reproductive health care.

As called for in Project 2025, the Trump administration announces it would not interpret EMTALA (the Emergency Medical Treatment and Labor Act) as protecting pregnant patients seeking emergency abortion care. Trump officials seek to dismiss a Biden-era lawsuit filed to prevent Idaho’s abortion ban from interfering with emergency reproductive care. The U.S. Supreme Court in June 2024 declined to rule definitively in the case and kicked the issue back to the lower courts.

The Indiana Supreme Court allows a preliminary injunction to stand against Indiana’s near-total abortion ban. The case was brought on behalf of Jewish and other Hoosiers who argue the ban violates their religious freedom. A lower court judge had noted the ban unconstitutionally “preferred one creed over another,” an argument made in a friend-of-the-court brief filed in the case by Americans United and allies.

AU and allies claim victory and dismiss the lawsuit filed on behalf of 13 Missouri clergy who sued to overturn the state’s total abortion ban as a violation of church-state separation. The action came on the heels of Missouri voters enshrining the right to abortion in their state constitution.

Americans United leads the National Coalition for In a case brought by a Christian Nationalist Shadow Network group, the U.S. Supreme Court denies standing to anti-abortion activists and leaves in place the FDA’s approval of the abortion medication mifepristone.

Americans United denounces a religion-infused Alabama Supreme Court decision that imperiled the ability of Alabamians to have children through in vitro fertilization and could prevent people from making their own decisions about their reproductive health care based on their own beliefs.

The Biden administration revokes the Trump-era Denial of Care Rule, which invited health care providers to cite their religious beliefs to deny care to anyone, even in emergencies. While everyone was at risk, the rule was particularly aimed at people seeking reproductive health care and LGBTQ+ people. The rule previously had been blocked from going into effect by a federal judge in response to lawsuits brought by AU and allies.

In response to the U.S. Supreme Court’s decision to overturn that nationwide right to abortion in the Dobbs v. Jackson Women’s Health Organization case, Americans United vows to fight abortion bans and other restrictions on reproductive health care that violate church-state separation.

In Trump v. Pennsylvania, the U.S. Supreme Court rules that the Trump administration didn’t violate procedural rules when it implemented regulations that allow employers and universities to use religion to deny workers and students birth control coverage guaranteed by law. Because this religious exemption causes harm, Americans United continued to challenge the rules in court on behalf of Notre Dame students and urged President Biden to revoke these rules.

In Burwell v. Hobby Lobby, the U.S. Supreme Court rules that the Religious Freedom Restoration Act (RFRA) entitles for-profit corporations with religious objections to contraceptives to deny workers the birth control access guaranteed by law. In Hobby Lobby and other similar cases, AU filed critical friend-of-the-court briefs opposing corporations getting religious exemptions that harm others.

President Obama signs the landmark Affordable Care Act (ACA) into law, which requires health insurance plans provided by employers and universities to cover all FDA-approved forms of contraception with no copay. This policy was designed to improve access to birth control, which is vital to people’s health and equality. Soon after, for-profit corporations, nonprofit organizations and universities began seeking religious exemptions to avoid complying with the law, and AU fought back.
