AU Protects Public Education for All

Summary

Public education is a cornerstone of American life; it is essential to our democracy and our success as a nation. Ninety percent of America’s children attend public schools. AU works to protect public education by ensuring (1) that public funds go to public schools, and (2) that those public schools remain inclusive and do not promote religion or force anyone to take part in religious activities.

The Harm of Private School Vouchers

Millions of parents and their children rely on public education. That’s why public funds must go to public schools and not be diverted to private school vouchers which pay for the education of students in private, predominantly religious schools. Private school vouchers are rooted in racism. White Christian Nationalists first created vouchers to allow white families to evade public school integration orders in the wake of Brown v. Board of Education.

Often, vouchers go to families that are already sending their kids to private schools. Private school vouchers don’t give any choice to most families who can’t afford private school tuition even with a voucher. Students in voucher programs also lose the civil rights protections they would have in public schools. For example, private schools that accept taxpayer-funded vouchers often deny admission to, or expel, LGBTQ+ students and students with LGBTQ+ family members. And they often claim that religious freedom gives them this right.

Fighting for families in public education

The separation of church and state ensures that families, not politicians, decide if, when and how to engage with religion. When public schools sponsor devotional practices or introduce religion into science classes, they are favoring one religion over others and excluding students of minority faiths and the nonreligious.

Christian Nationalist groups and extremists like Oklahoma State Superintendent Ryan Walters, Louisiana Governor Jeff Landry, and lawmakers in the Texas State Legislature are trying to use public schools to push a narrow version of one particular faith, and that undermines equality for people of color, women, LGBTQ+ people, religious minorities, the nonreligious, and even Christians with different interpretations of their faith. Using public schools to impose religion on children threatens the religious freedom of families with diverse beliefs, including Jews, Muslims, and LGBTQ+ individuals. Americans United and our allies are actively fighting these threats in court.

The separation of church and state ensures that all people—whether they are religious or not—are treated the same. It also guarantees that everyone has equal access to public schools and government services—full civil rights regardless of who they are or what they believe.

Americans United is dedicated to safeguarding this constitutional promise. We fight in the courts, legislatures and public square to maintain a public education system that remains inclusive and secular, welcoming the diverse beliefs of every student.

What You Should Know:

Public-school chaplains bills

Public-school chaplains bills

Bills that would put religious chaplains in public schools in place of qualified school counselors have been signed into law in Florida, Louisiana and Texas. At least 16 other states have chaplains bills pending. AU and our allies are fighting these bills.

Ten Commandments in public schools

Ten Commandments in public schools

Louisiana Gov. Jeff Landry signed a law requiring all public schools to display the Ten Commandments. This law is unconstitutional and violates more than 40 years of Supreme Court precedent. The families fighting this bill are represented by AU and our allies.

Project 2025

Project 2025

Under Project 2025 & the Trump administration, the Department of Education, which ensures quality education and equal access, is under threat. Trump and his allies call for funneling public money to private, mostly religious schools, rolling back civil rights protections for LGBTQ+ students, whitewashing history, and imposing white Christian Nationalist views on public school children.

MILESTONES

Timeline:

January 2025
The U.S. Supreme Court agrees to hear a case challenging the nation’s first religious public school; the case will likely be argued in April 2025. The Oklahoma Supreme Court barred the creation of St. Isidore of Seville Catholic Virtual School, ruling that state law “does not allow a charter school to be sectarian in its programs, admissions policies, employment practices and operations.” AU and allies are challenging the school’s creation in a separate lawsuit.

Ten Commandments
November 2024
In a lawsuit filed by AU and allies, a federal district court issues a preliminary injunction to block enforcement of a Louisiana law that requires public schools to post the Ten Commandments in every classroom. The lawsuit was filed on behalf of nine multifaith Louisiana families with children in public schools.

AU and allies file a lawsuit on behalf of more than 30 Oklahomans – including parents and children, public school teachers and faith leaders – to block state Oklahoma Superintendent of Public Instruction Ryan Walters’ mandate that all public schools incorporate the Bible into their curricula, and his plan to spend millions of taxpayer dollars on Bibles.

Americans United leads the National Coalition for Public Education’s efforts to release an updated toolkit to help legislators and advocates oppose attempts to create or expand vouchers in the states. We shared the toolkit with legislators and advocates in more than 20 states.

The Bremerton Football Prayer Ruling Has Nothing To Do With Protecting Religious Freedom

Buying into what one federal judge called a “deceitful” narrative and ignoring AU’s arguments in defense of students’ religious freedom, the ultra-conservative bloc of the U.S. Supreme Court rules in favor of a public high school football coach who insisted he had a right to pray in front of students after games at the 50-yardline. The decision has emboldened Christian Nationalists seeking to put the Bible and Ten Commandments into public schools.

The U.S. Supreme Court rules in Carson v. Makin that Maine cannot exclude private religious schools from its tuition-assistance program for families who don't have public schools nearby. The court's decision triggers a dramatic increase in states proposing new or expanded private school voucher programs, which AU continues to fight.

Americans United issues a report detailing how the first Trump administration misused taxpayer funds under the Paycheck Protection Program – money that was supposed to help workers at small businesses who were at risk of losing their jobs due to the coronavirus pandemic – to funnel billions into the coffers of private, mostly religious schools.

The U.S. Supreme Court ruled in Espinoza v. Montana, requiring states to allow religious schools to receive private school vouchers if they have voucher programs. Americans United filed amicus briefs in the U.S. and Montana supreme courts. The decision spurred more than a dozen state legislatures to consider bills that would divert public money to private religious schools and AU fought back with its allies across the country.

In a victory for students and families whose religious freedom had been violated, AU reached a settlement with Bossier Parish Public Schools in Louisiana to end religious coercion by public school administrators, teachers and coaches. Multiple religious freedom violations included school events being held at churches or involving prayers as part of the official program; extensive promotion of religion within school athletic programs; teachers proselytizing in classrooms; and religious displays in classrooms and offices.

Americans United and allied groups won a powerful ruling from a federal court stopping instruction about “intelligent design” creationism in a Dover, Pa., public school. Americans United has continued to support sound science education in public schools and fought attempts by state legislatures and state boards of education to include creationism in science curriculum.
